Terms and Conditions: (UK)

Use of Private Data:

* It is a requirement, that users of this website, register with a valid email address in order to enjoy all the features of the website.

* email addresses and any other personal information supplied by the user will not be passed on to a third party and will only be used to verify a persons valid intention to use this site in a proper manner.

* By requesting our newsletter via email the registered user is giving permission to the site owner to send a reasonable amount of email notification of products, services and information regarding the site Oaktree Home and Garden Centre, in return the site owner will agree not to send any form of advertising material not connected to Oaktree Home and Garden Centre and restrict the number of emails sent to an individual email address to a maximum of one per day. In most cases this will be in the form of a weekly newsletter. The registered user has the option of removing themselves from the mailing list at any time by completing the appropriate form online.

* The name and address supplied by the user will be used to supply any goods ordered, and will not be passed on to a third party other than the person contracted to deliver goods on behalf of the seller (site owner) and purchased from this site.

* Telephone numbers supplied by users of this site will only be used by the site owner and / or the site owner’s employees, where a dispute over goods or delivery occurs and it is necessary to speak to the purchaser.

* Telephone numbers will not be divulged to a third party other than a party contracted by the site owner or an employee of the site owner, to deliver goods on the site owner’s behalf where the contractor requires a telephone number for delivery purposes.

Purchase & Payment:

* Before completing checkout please ensure that where there are options e.g. colour, size, quantity, that you have made the correct choices

* It is a requirement that a valid UK postal address with correct post code is provided by the buyer to assist proper delivery of the item. A contact telephone would be helpful although not obligatory. We cannot accept PO Box numbers as a delivery address.

* Purchases may be made by credit card or paypal payment using the online secure payment facility.

* Purchases may also be made (UK only) using cheque drawn on UK bank or by crossed postal order.

* Cheques and crossed postal orders (UK only) should be made payable to ‘Oaktree Nursery’

* If paying by cheque or postal order (UK only) please allow up to five working days for the payment to clear through the banking system before goods are dispatched. Uncrossed postal orders will be cashed before goods are dispatched.

Cancellation, Refunds & Returns:

* You have the right to cancel an order for whatever reason within seven days of receiving the item.

* If cancelling an order within the seven day limit, a full refund will be given upon receipt of the returned item(s)

* To cancel an order within the seven day ‘cooling off period’ in accordance with the Consumer Protection (Distance Selling) Regulations 2000 it is a requirement that the buyer notifies the seller (Oaktree Home and Garden Centre) in writing, of their intention to cancel the order. This can be done by normal mail to Oaktree Nursery, Dyers Lane, Hockley Heath, Solihull, West Midlands. B94 6RR or via electronic mail to sales@oaktreehomeandgarden.co.uk
Cancellations by telephone alone will not be accepted.

* In the event of goods being delivered which are subsequently found to be either faulty or damaged please inform the person delivering the item and then notify Oaktree Home and Garden Centre by the methods indicated above or, in this instance, by telephone either 0121 3702038 or mobile no. 07720 203107. Arrangements will be made for the return of the item and replacement or a full refund whichever is preferred. It would be helpful to the site owners to have photographic evidence to present to the insurers to support any claim for damages or faults. With this in mind please supply the site owner with any such information which may assist in the claim being processed.

* Faulty goods will be deemed as such dependant on the item and its normal purpose of use and the average life expectancy of such an item. Obvious faults (e.g a nest box without an entrance hole or a one handled lopper) will be replaced or the cost of the item refunded in full. Less obvious faults occuring after a period of time that in our opinion of the item is unreasonable providing the item has been used for the purpose intended will also be replaced or a full refund offered. Any changes, modifications or alterations to the product will invalidate our return policy. Similarly if the item has been used in a manner not in accordance with that for which it was designed will also invalidate the return policy.

* Certain items will be marked with invisible markings to pevent fraudulant returns and to enable us to check that the actual item sent by us is the same one being returned. The security markings will not inhibit the use or the enjoyment of the product and will not reduce the value of such products.

* Please notify us immediately (within 48 hours) upon discovery of damaged or faulty items. A reasonable time, determined by us, will be allowed for reporting faults which occur after the product has been used. Returns must be received by us no longer than ten working days following delivery to the customer or following notification by the customer of a damaged or faulty item.

* Items returned within the seven day ‘cooling off’ period and items returned as damaged or faulty will be subject to either a full refund of purchase price and original postage cost or an identical replacement of original item(s) (subject to stock availability) and free delivery. The choice is entirely up to the customer.

Delivery:

* All items will be delivered within the UK by Royal Mail and / or recognised courier service.

* Customers will be notified by email when their purchase has been dispatched.

* Packages weighing up to 100g (including packaging) will be dispatched using standard Royal Mail first class post (UK only)

* Packages weighing over 100g (including packaging) will be dispatched by Royal Mail Standard Parcels or approved Courier Service and will require a signature upon delivery. A tracking number will be supplied.

* Although not guaranteed, most deliveries will arrive next day, however, please allow up to three working days before reporting a non delivered item.

* If a specific delivery date is required e.g.next day, please contact us first before completing checkout and we will try our best to accomodate your needs.

* If you are unable to stay in to sign for a parcel please supply an alternative address when completing checkout where the item can be signed for.

Use of Site:

* Oaktree Nursery Home and Garden Centre is open to all, irrespective of age, race, creed and religion, please be aware of this when posting comments or articles for this site, any inappropriate language, comments or use of this site will cause the offender to be permanently blocked from using this site, following a warning from the proprietors.

* The proprietors reserve the right to edit any material submitted for publication if it is deemed to contain content or language likely to cause offence to another.

Terms & Conditions: (International) extra or alternative conditions which apply to oversees buyers.

Use of Private Data:

* The terms & conditions regarding the use of personal data in the UK also apply to international customers.

* It is a requirement that a valid shipping address with correct post / zip code is provided by the buyer to assist proper delivery of the item. A contact telephone would be helpful although not obligatory. We cannot accept PO Box numbers as a delivery address.

Cancellation, Refunds & Returns:

* The terms and conditions relating to cancellation, refunds and returns that apply to UK customers will also be similarly applied to International customers, the only change being that we will allow a longer time limit for returning items which will be fifteen working days.

Delivery:

* All items dispatched to addresses outside the UK will be dispatched by Royal Mail or recognised courier service using Air Mail international signed for.

* Delivery times will differ throughout the world, please allow at least five working days before reporting an item as not received.

* All customers will be notified by email on the day their package is dispatched.

Use of Site:

* The same terms apply to international visitors as those for residents of the UK.
